These Terms and Conditions govern the supply of goods sold by Caramelokids.co.uk.
1.1 All orders placed by you and purchases of goods from us (whether in the showroom, by telephone, via our website or by such other means as we may permit) are on the basis of these Terms and Conditions and are subject to acceptance by us either (as applicable): (i) by delivery of the goods to you; or (ii) by providing the goods you have purchased to you at our warehouse, at which point a legally binding contract is constituted between us.
1.2 The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.
2.1 We have a minimum spend of £500 for first customer orders and £150 for re-orders thereafter.
2.2 Our Recommended Retail Price is a minimum of 2.2. Customers that do not adhere to this risk a stop of supply of Caramelo Kids goods.
2.3 To make a purchase from our online store, you must register to become a trade client. Simply fill in the form and we will then send a unique username and password for you to access the site. Then, add the products to your basket, click checkout and proceed to payment. Accounts can be registered to ease future ordering.
2.4 All orders placed by you and purchases of goods by you are subject of acceptance by us (as described in clause 1.1). We reserve the right not to accept an order at any time and for any reason, we will not be liable to you or anyone else in this circumstance. Please ensure you have ordered everything needed for in the order at the time of placing. Any additional orders needing to be placed before the original order shipped will be treated as a new order and full shipping will be applied.

3.1 All Products and postage prices exclude Value Added Tax (VAT)
- Delivery and Title
4.1 We dispatch goods during the working week, Monday to Friday. We will aim to dispatch orders within 1-2 working days. Orders can be sent by our chosen courier and is dependent on the size of the order. This will range from a 1-3 working day service, however, this is an approximate delivery time scale and can be extended. We cannot be held accountable for orders delivered after 3 days.
4.2 Unless you choose to collect your order at our warehouse and except in exceptional circumstances we aim to deliver the order in accordance to our delivery terms and conditions and timescales. We reserve the right to deliver the order in instalments.
4.3 Delivery timescales are not guaranteed and may change during periods.
4.4 Caramelokids.co.uk cannot be held responsible for any delays incurred by our chosen courier companies used.
4.5 Before placing your order, please ensure you have referred to our delivery option on our website to ensure that we can deliver to your address. A valid signature may be required on collection and delivery. In the unlikely event you have not received your order, you must notify us immediately.
5.1 If you need to cancel your order please phone us on +44 (0) 1277 563699 or email us at firstname.lastname@example.org.
5.2 We will send you an email to confirm that your order is ready to dispatch. In accordance to clause 8, we reserve the right to make available to you a part order collection if an item or items are not in stock. Any follow up items can be delivered once we have contacted you to tell you the rest of the order is now in stock.
5.3 Items are available to collect during normal working hours of which are Monday to Friday 9.30am to 6pm.
5.4 We will need to check validity when collecting your order and you will need to bring with you the email containing your confirmation of order or the email telling you the order is ready to collect.
6.1 Bank Transfer – We welcome payments via Bank Transfer. To Pay by Bank transfer, please find the bank details at the bottom of the order. Amount must be paid in full. We will dispatch once confirmation of the transfer has been made. Please note that this method of payment could take longer to process the order placed.
6.2 Credit/Debit Card/Over the Phone- We accept credit/debit cards. One of our sales representatives will be in touch shortly after submitting your order. We will dispatch the goods once payment has been verified.
- Returns/Cancellations and Refunds
7.1 You may cancel your order and return the items purchased to us by giving us notice of cancellation within 14 days of initial purchase. In relation to goods being delivered to you, you may need to take delivery of the goods before cancellation can take effect.
7.2 You will lose your right to cancel after the expiry of the 14 days from date of purchase (this does not affect your rights if there is any problem with the goods)
7.3 To exercise your right to cancel, you may inform us by email or phone. If you are cancelling the order due to problems with the goods you will need to inform us of the problem at the time of cancellation.
7.4 On cancellation for whatever reason, where you have received the goods you must return the goods to us (together with the original packaging) within the 14 days at your cost as set out in clause 8.1.
7.5 Following cancellation subject to clause 8.7, we will refund you the price paid for the goods (or part of the order cancelled).
7.6 We will refund you using the same means of payment as you used to pay for your order or by credit.
7.7 We reserve the right to make a deduction from the amount of the refund for loss in value of the goods returned where the goods show signs of unreasonable use; for these purposes, unreasonable use includes handling the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods. We may withhold any refund until we have received the goods or you have supplied proof of return for the goods.
7.8 Without prejudice to your right to cancel orders generally under this clause 7, if you have notified us of a problem with the goods within 30 days of delivery or collection, we may at our option either offer to make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery or collection; or cancel the order (or part of the order affected) and refund to you the amount paid by you for the goods in question.
7.10 No claims will be entertained after 14 days of purchase.
7.11 Please note, that under no circumstances will claims be entertained if the garments have been further processed i.e. printed or embroidered.
7.12 Carriage costs are not refundable.
- Stock Availability
8.1 All goods are subject to availability. While we endeavour to hold sufficient stock to meet all orders and purchases, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we will attempt to contact you using the details you have provided to us to ask you how you wish to proceed. We may, at our discretion, process any part of the order which is available. Where goods are out of stock, we will refund you the price paid for such goods as soon as possible and in any case within 14 days.
8.2 We cannot guarantee supply of stock at any time.
9.1 Caramelokids.co.uk do not hold, store or record any details relating to credit/debit cards.We do hold details such as customer contact information on very secure databases, however you can be assured that this information will never be passed on to any 3rd party.
9.2 We cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from our website.
10.1 If you purchase goods from us as a consumer (which means anyone who acts outside the course of their business, trade or profession), to the extent not prohibited by law, we accept no liability for any:
10.1.1 loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you and we entered into our contract);
10.1.2 loss which arises when we are not at fault or in breach of these Terms and Conditions; and
10.1.3 business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption).
10.2 If you are a trade customer, we shall have no liability to compensate you (whether in contract, tort (including negligence), breach of statutory duty or otherwise), other than any refund we make under these Terms and Conditions or otherwise at our discretion.
10.3 Without prejudice to clause 10.2, if you are a trade customer, we shall not be liable to you(whether in contract, tort (including negligence), breach of statutory duty or otherwise)for any: (i) loss of profits, business, contracts, goodwill, business opportunity and other similar losses, or any business interruption; or (ii) indirect or consequential loss, neither will we be liable to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.
10.4 If you are a trade customer, you acknowledge and agree that these Terms and Conditions constitute the entire and only agreement between us.
10.5 Nothing in these Terms and Conditions is intended to affect your legal rights if you are a consumer, nor is it intended to exclude or limit our liability to you for fraud, fraudulent misrepresentation, for death or personal injury resulting from our negligence or for any other liability which cannot be limited or excluded as a matter of applicable law.
10.6 Goods are manufactured according to laws and guidelines in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK.
10.7 If you are a trade customer and subject to clause 10.5, we will not be responsible to you or, in the event that you are undertaking work for another person, to any other person, for the use of any goods by you. Accordingly, if you are a trade customer, you hereby agree to hold us harmless from and indemnify us against any liability associated with, any claim or allegation that we are responsible for any failings in the installation or use of goods that we supply.
